Terms & Conditions
These terms and conditions apply to all bookings and to the use of the ParkingKong platform.
1. Definitions
ParkingKong: ParkingKong B.V., the provider of this platform, a private limited company (besloten vennootschap) with its registered seat in Eindhoven, the Netherlands, registered with the Dutch Chamber of Commerce under number 42153228.
User: the natural person who uses the platform and/or makes a booking.
Parking provider: the operator of the car park where the reserved space is located.
Booking: the agreement for a parking space concluded via ParkingKong.
2. About ParkingKong and our role
ParkingKong is a comparison and booking platform for airport parking in the Netherlands, Belgium and Germany.
We do not sell the parking service ourselves. Your parking contract is with the parking provider of the location you choose. That party performs the parking service and sets the conditions on site. Who it is, is shown on the provider page before you book and in your booking confirmation afterwards.
ParkingKong acts as intermediary. We show the offer, take your booking, place it with the parking provider and collect the payment on their behalf. Paying us means you have paid the parking provider; they cannot make you pay a second time.
Your customer service runs through ParkingKong. We are your point of contact for your booking, your payment, a cancellation or change and a complaint, including when we have to take it up with the parking provider.
The parking provider is responsible for the parking service itself — the space, access, any shuttle and the care of your car. We are responsible for our own intermediation, for the information we show and for processing your payment. Your mandatory consumer rights remain fully in force, towards both parties.
3. Formation of the agreement
Your booking is an offer to the parking provider, which we pass on for you. The agreement with the parking provider is formed at the moment we confirm your booking by email.
You receive that confirmation by email with your ParkingKong booking number and the parking provider’s details. Check the details and contact us immediately if anything is incorrect.
If your booking cannot be placed with the parking provider, for example because there is no space after all, no agreement comes about. You then get the full amount back, in the way set out in article 6.
4. Prices and payment
All prices shown are in euros and include VAT unless stated otherwise.
Payment is made via the payment methods offered on the platform. Your booking is only final once payment has been received.
5. Right of withdrawal
As a consumer, you generally have the right to withdraw from the agreement within 14 days without giving any reason.
Important exception: for services with a fixed performance period (such as a parking booking for a specific period), the right of withdrawal lapses once the service has, with your express consent, started or been fully performed before the end of the withdrawal period. When booking you expressly agree to this and acknowledge that you thereby lose your right of withdrawal.
Insofar as the right of withdrawal applies, you can exercise it via klantenservice@parkingkong.com.
6. Cancellation and changes
Cancellations and changes are subject to the conditions of the parking provider where you park. You see those conditions before you book: with the product on the provider page, in the booking steps and on the payment page. After booking, the same text is shown with your booking; that is the version that applies to it.
You cancel and change through “My booking”. If the parking provider cannot process a cancellation automatically, or no cancellation policy was recorded for your booking, your request goes to our customer service. We handle it in line with the parking provider’s conditions and tell you what you get back.
A change, for example of date or time, is only possible if the parking provider allows it and there is space. We settle any difference in price both ways and agree it with you beforehand.
If you get money back, it goes to the payment method you paid with, or as credit to your ParkingKong wallet — for example when you paid with wallet credit. Before you cancel, “My booking” shows you the amount you get back and where it goes. We collect on the parking provider’s behalf and handle the refund for you as well; you do not have to approach the parking provider yourself.
7. Liability
ParkingKong makes every effort to display prices, availability and information correctly, but cannot always rule out obvious errors or interim changes.
The actual parking service and the security of the site are the responsibility of the parking provider. ParkingKong is not liable for damage to or theft of vehicles on the car park.
Our liability is, to the extent permitted by law, limited to the amount of the relevant booking. This limitation does not apply in cases of intent or gross negligence, nor for damage to life, body or health.
8. Complaints and disputes
Do you have a complaint about your booking or about ParkingKong? Contact our customer service via the contact form on the website or at klantenservice@parkingkong.com and quote your booking number.
If your complaint is about the parking service itself, for example the car park or the shuttle, we will raise it with the parking provider and keep you informed.
We aim to respond within 5 working days. If we cannot resolve it together, you can take the dispute to the competent court (see article 9).
9. Applicable law
The agreement is governed by the law of the country where you, as a consumer, have your habitual residence: Dutch law for users in the Netherlands, Belgian law for users in Belgium and German law for users in Germany.
The mandatory consumer protection of your country of residence always remains in force. Disputes are submitted to the court having jurisdiction under the applicable law.
